
CAPE CORAL, Fla. — On Saturday, October 4, 2025, at approximately 11:33 PM, officers with the Cape Coral Police Department responded to a report of a reckless driver near Del Prado Blvd S and Veterans Parkway. A witness reported that a silver Honda Odyssey ran a red light, drove into oncoming traffic, struck a cement barrier on the Cape Coral Bridge, and hit a median barrier on Del Prado Blvd S.
An officer located the vehicle driving northbound at the 2700 block of Del Prado Blvd S. The driver was weaving through traffic at an estimated speed of 53 mph in a 40 mph zone. Officers initiated a traffic stop at the 2500 block of Del Prado Blvd S.
The officer approached the driver’s side door and tried to tell the female driver, later identified by her Florida Driver’s License as Jana Labash (DOB 03/07/1974), the reason for the stop. However, Labash reversed the vehicle and began going back, nearly hitting the patrol car. The officer again advised Labash to put the vehicle in park, but she put it in drive and began going forward. Another officer on scene had to assist Labash in putting the car in park. Officers asked her to step out of the vehicle, but she stared blankly. Officers then opened the door and assisted her in getting out of the car.
Once out of the vehicle, Labash displayed signs of impairment, including unsteadiness, slurred speech, bloodshot eyes, and the odor of alcohol emitting from her breath. Officers asked her to participate in Standard Field Sobriety Evaluations. Labash was uncooperative and argumentative. She kept asking the officer, who was communicating in clear English, to speak in English. Throughout the SFSEs, Labash continued to be uncooperative. Based on the totality of circumstances, Labash was arrested for DUI.
Labash refused to provide a breath sample, which, under Florida law, is now punishable as a second-degree misdemeanor for first-time refusals (as of October 1). At the Lee County Jail, she continued to resist deputies and was taken into custody as disorderly.
Jana Labash (DOB 03/07/1974) is facing the following charges:
- 1 count of Driving Under the Influence (F.S.S. 316.193(1)(a))
- 1 count of Refusal to Submit to DUI Testing (F.S.S. 316.1939 (1)(d))
As of October 6, 2025, the Cape Coral Police Department has recorded 314 DUI arrests. The department has had 3 arrests under the new refusal statute.
