(February 20, 2025) — On February 13, 2025, at approximately 5:31 a.m., the Cape Coral Police Department received a 9-1-1 call in reference to a shooting that occurred in the area of 3030 Skyline Boulevard in Cape Coral, Florida.
When officers arrived, they located a thirteen-year-old male in the front passenger seat of a vehicle suffering from a gunshot wound to his back. Three other males fled the scene on foot, and two were located and arrested.
The Violent Crimes Unit responded and assumed the investigation. It was confirmed that earlier in the evening, the vehicle that the victim was shot in had been stolen in Cape Coral. An additional vehicle had also been stolen that contained two handguns, one of which was used in the shooting. That handgun was later recovered. The facts of the investigation determined that the shooting was accidental. The third male who fled the scene was located and arrested on February 19, 2025, and confirmed to be the one who accidentally shot the victim. Brennan Smith (DOB 03/29/2012) was charged with the following:
–1 count in violation of Florida State Statute 790.07(2), Persons Engaged in Criminal Offense with Weapons, a Felony of the Second Degree
–1 count in violation of Florida State Statute 812.014(2)(c)(6), Grand Theft of an Automobile, a Felony of the Third Degree
–2 counts in violation of Florida State Statute 812.014(2)(c)(5), Grand Theft of a Firearm, a Felony of the 3rd Degree
–1 count in violation of Florida State Statue 790.22(3), Minor in Possession of a Firearm, a Misdemeanor of the First Degree
–1 count in violation of Florida State Statue 790.10, Improper Exhibition of a Firearm, a Misdemeanor of the First Degree
–1 count in violation of Florida State Statute 784.05(2), Culpable Negligence, a Misdemeanor of the Second Degree
