Woman arrested after Facebook Marketplace forgery

(October 3, 2024) — On Wednesday, October 2, 2024 at approximately 5:24 PM, officers working for the Cape Coral Police Department responded to a residence on Everest Parkway in Southeast Cape Coral for a trespass issue.

When Officers arrived on scene, Diana Morgenthal (DOB 5/24/1992) was in the side yard of the residence standing next to a boat in the backyard. Diana was previously issued a trespass warning from the address.

Officers discovered Morgenthal created a Facebook Marketplace listing for an aluminum boat and trailer for sale for $500. Morgenthal organized a buyer to come and look at the boat. That potential “buyer” was on the property when officers arrived. Neither the boat nor trailer belonged to Morgenthal and thus was not hers to sell. She additionally falsified a signed bill of sale, forging the owner’s signature.

Officers spoke with the true owner of the boat, who advised that Morgenthal was previously trespassed from the property and was never given permission to sell the boat or trailer. The owner advised the value of the boat is $600 and the value of the trailer is $600.

Morgenthal was placed under arrest, taken to the Lee County Jail, and charged with the following:

–1 count in violation of F.S.S. 812.014(2)(c)(1), Grand theft

— 1 count in violation of F.S.S. 810.09(1)(a)(1), Trespass after warning

–1 count in violation of F.S.S. 319.33(1)(e), Falsifying bill of sale of a vehicle

— 1 count in violation of F.S.S. 328.05(3)(c), Falsifying bill of sale of a vessel
