(August 29, 2024) — On April 28, 2024, the victim reported visiting Howard at his residence, 708 SE 9th Place in Cape Coral, falling asleep at his home. The victim woke up being sexually battered by a man identified as Brian Lee Howard (DOB 05/15/1978). The victim immediately left the residence and contacted law enforcement.
Howard was interviewed at the time of the alleged offense and denied the allegations. As part of the investigation, the victim submitted to a sexual assault examination, and the DNA of Howard was collected.
On August 15, 2024, the results of the DNA analysis from the Florida Department of Law Enforcement confirmed Howard as a suspect in this case.
Howard was arrested and charged with the following:
 –1 count in violation of F.S.S. 794.011(5b), Sexual BatteryÂ
