(July 22, 2024) — On Saturday, July 20, 2024 at around 3:16 AM, an officer with the Cape Coral Police Department conducted a traffic stop at the 1100 block of Del Prado Blvd S, Cape Coral, Florida.
The driver of a red motorcycle was exiting a parking lot with a passenger to turn right onto the northbound lanes of Del Prado Blvd S and traveled across all lanes of traffic, violating F.S.S. 316.151(1)(a)(1), which states a driver turning right must turn as close as possible to the right-hand edge of the roadway.
When the officer explained the reason for the stop and asked for the driver’s license, registration, and proof of insurance, the driver said he had just purchased the motorcycle 3 hours ago, did not have it registered, did not have a motorcycle endorsement, and didn’t have his license on him. When asked his name and date of birth, the driver initially gave a false name and a birthday of 05/13/1992. He then said his birthday was 05/13/1991, then said 05/13/1992 again. The investigation revealed his actual name and date of birth to be David Hunter Gill (DOB 11/28/1990). Officers and Dispatch determined he had a suspended Mississippi driver’s license, no motorcycle endorsement, and three warrants out of Lee County, Sarasota County, and Mississippi State.
The passenger, identified as Jamie Lynn Rutland (DOB 11/18/1977), had six warrants out of Lee County.
Both Gill and Rutland were put in handcuffs. A search revealed:
–A clear pipe with black/burned residue, which tested positive for the presence of methamphetamine
–2 clear bags of a white crystal-like substance, which both tested positive for the presence of methamphetamine
–A pill bottle prescribed to another person containing Alprazolam pills
David Hunter Gill was taken to the Lee County Jail and charged with the following:Â
–1 count in violation of F.S.S. 901.36(1) – False Name to Law Enforcement Officer
–1 count in violation of F.S.S. 320.02(1) – Failure to Register Motor Vehicle
–1 count in violation of F.S.S. 322.03(4) – Operating a Motorcycle without an Endorsement
–1 count in violation of F.S.S. 322.34(2)(a) – Driving with a Suspended License
–1 count in violation of F.S.S. 893.13(6)(a) – Possession of Methamphetamine
–1 count in violation of F.S.S. 893.147(1) – Possession of Paraphernalia
–1 count in violation of F.S.S. 843.15(1)(b) – Failure to Appear (Lee County)
–1 count in violation of F.S.S. 901.15(4) – Out of County Warrant (Sarasota County)
–1 count in violation of F.S.S. 941.02 – Out of State Fugitive Warrant (Mississippi Department of Corrections)
