Man Arrested for Aggravated Assault with Pellet Gun

CAPE CORAL, Fla. — On May 15, 2026, just after 5:45 p.m., officers with the Cape Coral Police Department responded to a disturbance at 1510 SE 42nd St., Cape Coral, Florida.

Officers met with the caller, who stated he had been hired to do work in the area. The caller said the resident of 1510 SE 42nd St., identified as Sergio Roberto Hernandez (DOB 11/17/1966), came outside and began arguing with him and telling him to move his truck. The caller stated Hernandez then pointed what appeared to be a black pistol at him while standing within approximately 10 feet. The caller said he feared Hernandez was going to shoot him and wished to pursue charges.

Officers also spoke with witnesses who corroborated the caller’s account. They said they heard yelling and observed Hernandez point a weapon directly at the caller.

Officers then spoke with Hernandez and recovered the weapon involved, which was determined to be a black handgun-style pellet gun resembling a standard firearm. The pellet gun was not loaded.

Based on the victim’s belief that the firearm was real and that Hernandez appeared to have the ability and intent to be violent with the weapon, along with the witness statements provided, Sergio Roberto Hernandez was arrested and taken to the Lee County Jail on the following charge:

  • Aggravated Assault with a Deadly Weapon without Intent to Kill
