More Charges in Juvenile Shooting Investigation

(March 27, 2025) — The Cape Coral Police Department’s Violent Crimes Unit is investigating a series of incidents involving a shooting and multiple vehicle thefts that occurred on February 13, 2025, involving several juveniles.

We previously released the following information:

On February 13, 2025, CCPD received a call regarding a shooting at 3030 Skyline Blvd. The caller, later identified as Brennan Smith (DOB 03/29/2012), reported that his friend had accidentally shot himself. Upon arriving at the scene, officers found Qwa’miere Preston (DOB 02/22/2011) in the front passenger seat of a silver Nissan Rogue, suffering from a gunshot wound to his back. The other occupants of the vehicle fled before police arrived. Preston was transported to a hospital for medical treatment.

Further investigations revealed the following:

Shortly after the shooting, a victim reported their 2013 blue Mitsubishi Outlander Sport stolen. The vehicle contained two firearms.

It was determined that Preston stole the Mitsubishi Outlander and went to pick up Smith. The two can be seen on video at a local 7-Eleven filling the car up with gas before driving it and getting it stuck in the sand. The vehicle was left abandoned and later recovered by officers.

Violent Crimes Detectives discovered videos on a cell phone showing Preston and Smith inside the Mitsubishi, handling the stolen firearms and committing reckless acts with them. The videos also captured the pair driving a stolen Nissan Rogue before picking up other juveniles.

Preston and Smith picked up Michael Hernandez (DOB 12/29/2009) and Antonio Lubin (DOB 05/29/2010). The investigation revealed Hernandez was the driver of a knowingly stolen vehicle when the front seat passenger, Preston, was shot. Lubin and Smith were passengers during this time. Lubin and Hernandez fled from the scene, but they were later located by detectives. Inside the stolen vehicle, there were two firearms belonging to the other victim. Lubin and Hernandez knew the guns and vehicle were stolen and had assisted in depriving the victim of their property. Hernandez has an active Risk Protection Order and is not to be in possession of firearms.

Qwa’miere Preston (DOB 02/22/2011) was arrested and charged with the following:

–1 count in violation of FSS 810.02(2)(b) – Armed Burglary of a Conveyance, 1st Degree Felony.

–1 count in violation of FSS 812.014(2)(c)(6) – Grand Theft of a Motor Vehicle, 3d Degree Felony.

–2 counts in violation of F.S.S. 812.014(2)(c)(5) – Grand Theft of a Firearm, 3rd Degree Felony.

–1 count in violation of F.S.S. 790.22(3) – Minor in Possession of a Firearm, 1st Degree Misdemeanor.

–1 count in violation of F.S.S. 790.10 – Improper Exhibition of a Firearm, 1st Degree Misdemeanor.

Michael De Jesus Hernandez Narvaez (DOB 12/29/2009) was already in custody at the Department of Juvenile Justice and charged with the following:

–2 counts in violation of Florida State Statue 812.014(2)(c)(5) – Grand Theft Firearm, a Felony of the 3rd Degree.

–1 count in violation of Florida State Statue 790.401(11)(b) – Possession of a Firearm in Violation of Risk Protection Order, a Felony of the 3rd Degree.

–1 count in violation of F.S.S. 812.014(2)(c)(6) – Grand Theft Automobile, a Felony of the 3rd Degree.

Antonio Joseph Lubin (DOB 05/29/2010) was arrested and charged with the following:

–1 count in violation of F.S.S. 812.014(2)(c)(6) – Grand Theft of a Motor Vehicle, a Felony of the Third Degree.

–1 count in violation of Florida State Statue 812.014(2)(c)(5) – Grand Theft Firearm, a Felony of the 3rd Degree.

In addition to his previous charges, Brennan Smith (DOB 03/29/2012) was already in the custody of the Department of Juvenile Justice and was charged with the following:

–1 count in violation of F.S.S. 810.02(2)(b) – Armed Burglary of a Conveyance, a Felony of the Second Degree.

–1 count in violation of F.S.S. 812.014(2)(c)(6) – Grand Theft of a Motor Vehicle, a Felony of the Third Degree.

The investigation is still ongoing.
