(June 5, 2024) — On May 27, 2024, around 11:30 AM, Officers working for the Cape Coral Police Department responded to an area of northeast Cape Coral for reports of a battery.
Officers met with the 72-year-old victim, who said she was walking down her street when an unknown male ran up behind her and grabbed her buttocks. The victim was able to give a detailed description of the man and also advised she may have seen him at a nearby construction home.
Officers went to the construction home and were unable to locate a male matching that description.
On May 30, Detectives received video footage that showed a male exiting the construction home and walking down the street toward the victim. The male was later identified as Luis Esteban Duarte Garcia (DOB 7/04/2005). Duarte Garcia first watched the victim for a few moments and then ran after her. Footage then showed Duarte Garcia running back to the construction site, switching shirts, and continuing to work.
Detectives went back to the construction home and located Duarte Garcia. He was taken into custody without further incident.
Luis Esteban Duarte Garcia (DOB 7/04/2005) was arrested and charged with the following:
–1 count in violation of F.S.S. 784.08(2)(c), Battery on a Person 65 Years of Age or Older
